Is the title of your home in you and your spouse's individual names? If so, you have probate in your future.Probate is the legal process to determine who should receive a deceased person's assets.
- Probate costs an average of 3 - 10% of a person's overall estate.
- Probate lasts an average of 9 months to 2 years.
- Real estate (your home) is subject to probate.
- A Will is subject to probate.
The easiest way to avoid probate is to put your home and other assets into a revocable living trust. When you create a trust, you can legally transfer all your property (and other assets like bank accounts, life insurance etc.) into your trust. While you are alive, you maintain full control of everything. But, if something happens to you, the trust designates who can legally take control of those assets. So, as long as you transfer all your property and assets into the trust while you are alive, you can completely avoid the probate process and make things easier for those that you leave behind.
If a trust is such an easy solution, why is it estimated that only 5% of people have a trust?
Frankly, it boils down to knowledge and cost. Many people don’t know how revocable living trusts work or are scared away by the high price tag that many attorneys charge. Most attorneys charge a minimum of $1800 for a complete trust package. While many people recognize the importance, they just don't want to spend that kind of money.
